Now, Steven Breyer is the oldest justice and he has been put in place by Clinton. Just imagine Trump wins 2020 (as I think he will) – at 82 he must hold out for another 4 years and then he must hope that Trump’s successor is not a Republican. There is a better than zero chance for the Supreme Court to get a conservative supermajority. What would that do to the thick wad of lifeblood draining regulation that hobbles US business?
